The opinions of both the local authorities and the European Commission have been taken into account. The successful adoption of the draft will fulfil the Ukraine Facility indicator.
The Subcommittee on Administrative-Territorial Structure and Local Self-Government supported Draft Law No. 14048 ‘On Amendments to Certain Legislative Acts of Ukraine Regarding Ensuring Legality and Transparency in the Activities of Local Governments’ and recommended it for a second reading.
This was announced by the Chairman of the Subcommittee, Member of Parliament of Ukraine Vitalii Bezgin.
‘The Subcommittee supported Draft Law No. 14048, recommending it for a second reading! One amendment was accepted. Two thousand four hundred and sixteen amendments were rejected. The following aspects were taken into account: the position of the local authorities that argued that supervision should specifically be exercised over delegated powers; and the position of the European Commission that the issue of personnel reserves should be resolved not in this draft law, but in the legislation regulating the civil service. The relevant provisions have been removed,’ wrote Vitalii Bezgin on his Facebook page.
As outlined in the explanatory note, the objective of the draft law is to establish an effective system to ensure the legality of local government acts. The document proposes introducing a clear mechanism for state supervision of local government decisions, as well as defining the responsibilities of central and local executive authorities for its implementation.
The key positions of local authorities and European partners were considered during the drafting process, demonstrating an open and coordinated approach to preparing this draft law. This is important for the continuation of decentralisation.
According to the MP, the successful adoption of the document in the version supported by the Subcommittee will not only improve the mechanisms for ensuring legality at the local level, but will also fulfil one of the indicators of the Ukraine Facility.
