The Ministry of Regional Development has developed a simple and understandable draft law whereby the amalgamated territorial communities are granted the right to dispose of the state-owned lands within the boundaries of their entire territories. That draft law has been long awaited by all ATCs. It will enhance the capability and investment attractiveness of communities.

Vice-Prime Minister - Minister of Regional Development, Construction and Housing and Communal Services of Ukraine Hennadii Zubko commented so during the meeting of the Cabinet of Ministers of Ukraine regarding the provisions of the draft law "On Amendments to Certain Legislative Acts of Ukraine Regarding Land Resources Management within the Territory of an ATC" as approved by the Government.

"We provide a powerful resource and a new push for the development of territorial communities. The right to dispose of lands owned by the state, deal with the matters pertaining to real estate development, determine a proper taxation base will allow raising investment funds for the amalgamated territorial communities in order to implement infrastructure projects and manage them in an effective manner. That is an important decision in the context of decentralisation and enhancement of capabilities of the communities", Hennadii Zubko noted.

The Vice-Prime Minister explained that the said draft law introduced amendments to the Land Code, the Law "On Local Self-Government in Ukraine", and the Law "On Land Lease" providing a number of additional powers to village, town and city councils in the ATCs. Those powers include the right to dispose of the state-owned lands, transfer such land plots into ownership or for use by individuals and legal entities, change the designated purpose of privately-owned land plots located within the territory of the amalgamated territorial communities. In addition, the draft law determines the list of state-owned lands which may not be transferred into municipal ownership; also, it defines the "territory of the territorial community" term.

Consequently, the state retains the powers to dispose of land plots of strategic importance: 

• natural reserves and other environmental-protection lands underlying natural reserve objects of national importance;
• lands underlying buildings, constructions, and other state-owned immovable property;
• lands used by governmental agencies, state-owned enterprises, institutions, and organisations (including lands for forestry purposes, defence lands) on a permanent basis.

As it was reported,, in pursuance of the instruction given by Prime Minister of Ukraine Volodymyr Groysman, the Ministry of Regional Development, jointly with experts, has developed a draft law regarding the transfer to the amalgamated territorial communities of powers in terms of land resources management in the entire territory of the community.
