How to legalise 35 unregistered workers per year. Experience of Mamalyhivska AH
Due to the steps taken to make businessmen comply with the labour legislation, the Mamalyhivska AH of the Chernivtsi Oblast managed to increase budget revenues by UAH 200 thousand.

The Mamalyhivska amalgamated hromada of the Chernivtsi Oblast with a population of more than 12 thousand people decided to take serious measures regarding unregistered workers, having seen this as potential to fill the budget.

“In general, we have a problem with PIT inflow,” complains Volodymyr Antonchuk, AH deputy head. “Last year the agricultural company, which was one of the largest taxpayers, split up, and therefore, part of the personal income tax we received earlier, moved to another rayon. Although the employees of the former agricultural company live in our hromada and use its infrastructure, it turns out that they do not pay taxes at all. Therefore, we decided that we should pay attention to the observance of labour laws by local entrepreneurs and legalise all illegally functioning enterprises, filling in the budget this way.

Therefore, in April last year, the Mamalyhivska AH introduced the position of a labour inspector. It was occupied on a part-time basis by Yaroslav Kushnir, head of HR and legal support department of the village council. Since he also leaches legal science at the Small Academy of Sciences in Chernivtsi, this is in fact his third job.

Jaroslav has a very serious scientific approach to the issue. First and foremost, he created lists of individuals and legal entities in each of the AH villages – with indication of the location and legal address, the code of the Unified State Register of Enterprises and Organisations of Ukrain, etc. It turned out that there are 201 private entrepreneurs and 49 legal entities operating in the AH, mainly specialising in agriculture and trade. However, only 64 enterprises employ workers legally. Yaroslav visited them to persuade. Some of the enterprises gave up easily: only in October last year 11 employees were registered in the Mamalyhivska AH. The labour inspector had to struggle for the others.
Thanks to his efforts, hromada businessmen were forced to register 35 employees per year. Due to this, the AH budget received additional UAH 200 thousand.
